organiser agreement
The terms for listing and selling Events on ZimFun. Read them alongside our Terms of Use, which set out what your guests can expect.
1. Our relationship
This agreement is between Bh3 Techs (“ZimFun”) and the business or person listing Events (“you”, the “Organiser”). You run your Events and contract directly with your guests; ZimFun provides the marketplace, booking records, ticketing, check-in tools and, if you connect it, Paynow online payments into your own account.
You accept this agreement when you create an organiser account. The person who accepts confirms they are authorised to bind the business.
2. Listings
- Describe every Event accurately: dates, venue, pickup point, what the price includes and excludes, optional extras and their prices, and your cancellation and refund terms.
- You hold, and will keep current, every licence, permit, park or operator registration, vehicle roadworthiness and insurance your Events need (for example ZTA registration where applicable).
- Use only photos and text you own or have permission to use. Don't list misleading prices, “fake scarcity”, or Events you can't deliver.
- Seats you set are binding: don't take bookings outside ZimFun for the same seats in a way that oversells. You can add seats at any time.
3. Plans and ZimFun's fees
You choose a plan on the Plans and fees page. Plans are priced per year; the Free plan costs nothing.
- Commission is a percentage of each confirmed booking's value (the booking total: packages, extras and seats, excluding any booking fee shown separately to the guest). It applies only after the free confirmed bookings your plan includes each calendar month.
- A booking counts as “confirmed” once its deposit or full payment is recorded. Cancelled and expired bookings carry no commission; if you refund a confirmed booking in full, its commission is reversed.
- The fee is worked out when the booking is made using your plan at that time, and shown on your dashboard. Plan or fee changes only affect new bookings, and we'll give you at least 30 days' notice of a price increase.
- Fees are charged to you, never added to your guests' price unless a plan says otherwise and the guest sees it before booking. We invoice commission monthly; invoices are due within 14 days.
- Yearly plan fees are paid in advance and are non-refundable, except where we end this agreement without cause.
4. Taking payments
You choose how each Event can be paid for and how payments are confirmed:
- Manual: cash, bank deposit or mobile money paid straight to you. You must check each proof of payment against your own statement before approving it, and record cash only when you have received it. You are responsible for the money you confirm.
- Automatic (Paynow): guests pay through your own Paynow merchant account and bookings confirm when Paynow reports the payment. You must keep that account in good standing and follow Paynow's terms. ZimFun never holds your guests' money.
Give every guest a receipt on request (ZimFun's ticket page shows the payments you recorded). Don't ask guests to pay outside the methods shown on your booking page.
5. Cancellations and refunds
- Honour the cancellation terms you publish. If you don't publish any, the default policy in our Terms of Use applies to your Events.
- If you cancel an Event, or make a major change a guest doesn't accept, refund everything they paid within 14 days, or move them to another date if they agree.
- You pay refunds yourself. Repeated failures to refund are grounds for suspension.
6. Running your Events
- Run Events safely, with competent guides, safe vehicles and the safety equipment the activity needs, and tell guests about real risks and requirements.
- Check tickets at pickup or entry with the ZimFun scanner. Each ticket admits its guests once.
- You are responsible for injury, loss or damage caused by your Events, staff, subcontractors and suppliers, and you will keep appropriate public liability insurance.
7. Guest information
- You receive guests' names, phone numbers, emails and booking details only to deliver the booked Event, contact guests about it, and meet your legal obligations.
- Don't use them for unrelated marketing without the guest's consent, don't sell or share them, and keep them secure — you are responsible as a controller under the Cyber and Data Protection Act [Chapter 12:07] for what you do with them.
- Give staff accounts only to people who need them, and remove access when someone leaves.
8. What isn't allowed
- Fraud, fake reviews (including reviewing your own Events), misleading listings, or approving payments you haven't received.
- Discrimination against guests, harassment, or anything illegal.
- Trying to get around ZimFun's fees by moving guests found on ZimFun to off-platform bookings for the same Event.
9. Suspension and ending this agreement
- You can close your organiser account at any time; you remain responsible for confirmed bookings and any fees owed.
- We may hide listings or suspend an account where there is a credible risk to guests, suspected fraud, unpaid fees, or a serious or repeated breach. Where we can, we'll tell you why first and give you a chance to fix it.
10. Liability and law
- ZimFun provides the platform with reasonable care but doesn't guarantee it will be uninterrupted. To the extent the law allows, our liability to you is limited to the fees you paid us in the 12 months before the claim.
- You will compensate ZimFun for claims by guests or third parties caused by your Events or your breach of this agreement.
- This agreement is governed by the laws of Zimbabwe, and the courts of Zimbabwe have jurisdiction.
